Golden Miner character glitch (not unlocked but selectable on certain menus)

He's unlocked in some of my menus and locked in others.
I do NOT meet the requirements to unlock him, frankly I'm quite away from earning him.
He is absent from the character select screens with their pictures displayed (Lobby and Multiplayer menu).
He is selectable while in matches, so after a match starts -> I push "Start" -> "Options" -> "Multiplayer" and now he is selectable there.

I don't know how long this has been happening as last night it was the first time I ever switched my character this way. Joined a game and EVERYONE on my team was the Queen, so wanted to switch.

Any reason for this glitch? I'm not complaining at all, however I don't want to get a ban for having him without the requirements.

Summary:
Main Menu -> Options -> Multiplayer -> He's absent and locked
Stats Screen -> Characters -> He's locked
In game -> Pause -> Options -> Multiplayer -> I can select him

If I select him, he remains my character in future games.

My friend had that happen to him, expect it was golden gear.

Yeah I know of a few that got him too - was later fixed in a update.
This one though I don't know of any who have it and don't see any posts of others having this same thing anywhere on these forums (also googled it too).
