Yes and no. You should be able to use them, as long as you remove any references to UT assets. basically, they are there as guidelines and you can more or less use whatever functionality you see there, just change it so the classes and referenced assets are only specific to your game.

Do you mean taking them out of UT3 and putting them in UDK?
I'm not sure about the UT3 ones. The ones that come with UDK are for sure.
For non-commercial applications you may use any part of the UDK.
For commercial applications you may not use the content that comes in UDK\UTGame\Content, iirc you are allowed to make use of the unrealscript code.
Not sure what the policy is concerning UT3 content.
