I am hoping someone can steer me in the right direction here... I am stuck at the end of Act 1 trying to dispatch the Berserker, but the Hammer of Dawn that I have on me is apparently out of juice...
The checkpoint starts with the Berserker bursting through a wall and I can get it out into the courtyard no problem... but when I am out there the Hammer of Dawn is empty and I see no place to refill or swap it. I think I have hit a catch 22 here.
Is there anything that I can do short of start over?

Yes, when you get out to the courtyard, turn left and move to the end of there, then it'll say hammer of dawn online (P.S A cog tag is hidden over there)
It worked for me, good luck

what he ^ says. and man i can't stand that level (or rather 'those levels'). everything else i'm playing over and over again as GoW 2's release draws nearer but the berserker encounters... okay, when i'm playing co-op it's no problem. it's just still kind of annoying but when i'm playing alone dom always gets killed because he's just standing there, pretty much waiting for the berserker to smash him

That's happened to me a couple of times. And if Dom gets injured I just leave him behind and hope it doesn't get killed. :p
But when I move forward quickly toward the beserker (near the doorway) then dodge the Berseker by turning in that room, I notice that Dom doesn't get hurt this way (at least not yet).
